Abstract

The aim of this article is to evaluate, from a legal point of view, whether the two Royal Decrees, approved on December 3rd and 4th, 2010, which mobilized air traffic controllers and decreted state of alarm, were legal and within the Spanish Constitution. In order to evaluate this, we have examined the proportionality of the means used, as well as its suitability to the exact case, which was the air crisis provoked by the concealed massive strike carried out by the Spanish airports’ air traffic controllers.
