Abstract

The Bosphorus Airways v. Ireland ruling sets a new stage in the relations between European Community Law an the ECtHR. With one move, on the one hand, it provide the European Community Law with a certificate of conformity with the ECtHR and on the other hand, it subordinates the European Community Law to the Convention, even though the Community has not ratified it, declaring the competence of the ECtHR over European Community Law to estimate if there is a «manifest deficiency» with regard to the Convention.
