Abstract

The application of the European Arrest Warrant has given rise to some very relevant pronouncements of Supreme and Constitutional Courts of the Member States. Those judgements are specially significant since they contribute to highlight some of the most controversial issues related to the legal nature of third pillar norms, in particular, to Framework Decisions. This paper analyses in a critical manner the elements of the aforementioned case law which refer to the relationship between acts of the third pillar of the European Union and national law.
