Abstract

The publicly owned private foundation is an increasingly common instrument for the management of activities at all levels of government. Nevertheless, problems arise from its lack of a uniform legal treatment that is applicable to all public administrations. Some insight is provided by solutions proposed in French and Italian law. In the former, a public entity was defined —the Groupement d’intérêt public— that enjoys the working advantages of the foundation without escaping from the framework of administrative law. In the latter, the civil foundation has undergone successive changes that adapt it to the demands of and on the public sector, or which introduce features of other kinds of institution, such as the association.
