Abstract

This contribution examines Law 21/2013, on environmental assessment. This Law repeals the existing environmental assessment legislation and unifies in various sections the legal regime applicable to the assessment of plans and projects. The Law has swiftly been adopted bearing in mind that an amendment to Directive 2011/92 (environmental assessment of projects) was under discussion at European Union level. The new Law includes a range of problematic aspects, such as the definition of the projects subject to assessment, the various procedural stages and the amendments to existing environmental reports, prepared by the so-called environmental authority in the case of plans and programmes, but not subject to time-frames.
