Abstract

Far from what some of the passages of the controversial and important Judgement of the Spanish Constitutional Court 112/2018 might imply, it does not enshrine the strict liability of the public Administration in Art. 106(2) of the Spanish Constitution. It is rather the fault-based liability of the Administration which has become guaranteed by this constitutional provision and can no longer be excluded by the legislator. The paper argues this thesis and examines the important role that corresponds to the legislator and the Supreme Court regarding the concretisation of the Spanish system of non-contractual liability of the Administration.
