Abstract

It is exceedingly frequent in administrative practice the undue prolongation of
temporary situations of public employees. With regard to those who have an employment
contract, the 4th Chamber of the Supreme Court adopted two decades ago the
controversial figure of undefined contract, as a sanction to these abusive practices and
as a guarantee of workers’ rights. Until now there was no similar solution in the case
of public employees with temporary ties subject to administrative law. Two recent
judgments of the Supreme Court, based on a previous one from the Court of Justice
of the European Union, respond to this problem.
