Abstract

This paper leaves from the Community reflection on public-private partnerships, to analyse what institutions in Spanish Law are concerned and what modifications of their present legal regulation would be necessary for their totally adaptation to the exigencies of European Union Law. The same systematics of Green Paper on public-private partnerships is followed, and so the study distinguishes between purely contractual and institutionalised public-private partnerships. Within first, Spanish contracts of management of public services, works concessions and contracts of collaboration between the public sector and the private sector, as well as city-planning concessions, are analysed. Within second, the paper makes an approaching to the legal regime of mixed economy societies, consortiums and public foundations. A last section is dedicated to the interadministrative agreements ofcontractual object, compared to public contracts by the jurisprudence of the Court of Justice of the European Union.
