Abstract

The vocation of the universality of the Administrative Law has been proved in America through the Administrative State. After the New Deal it has established public law principles in every governmental action, through a horizontal and vertical expansion, that has provide a qualitative component to measure its efficiency. During the last years, proposals for reform have challenged these principles, reviving the old conservative opposition between Politics and Administration. This has fostered technocratic solutions, carried out by «angels» who redeem the quantitative inefficiency. The current world economic crisis has demonstrated the falsehood of this belief and has proved the permanent need and validity of the principles of the Administrative State, because they had served to restrain efficiently the political and economic power as well as helped to reaching the protection of the common good which is projected beyond the national borders.
