Abstract

Since the mid-90s, there has been an important legal debate with political and ideological implications about the economic activity of German municipalities. On the one hand, municipal laws clearly state some requirements that set limits to the scope of action of themunicipalities on economic matters, but in fact these laws are not rigorously applied. Onthe other hand, a well-established tradition of judicial decisions has prevented competing private parties from going to court, even if competition from the state is unfair according tothe municipal laws.
