Abstract

The article analyses the supply of last resort (SUR) that is the great novelty introduced by Law 17/2007. The article criticizes the characterization of such supplier as an universal service provision, concluding that does not meet the characteristics that universal service should have in the EU law, and theorizes about the reasons for that characterization as not consistent with the material sense of the institution, that hides the meaning of regulation. The article explores the consequences of not setting the appropriate fee as a maximum, as established by the Act, but also as a minimum; as well as the reasons for the designation of dominant operators as providers, and the doubts about the benefits and the true role of SUR given the tariff's components.
