Abstract

This article analyzes the declassification of the Natura 2000 network in Spanish Law and its impact on the judicial review of projects, taking into account the most recent European Union Court of Justice case law. It is argued that Spain infringes European Union Law because it allows declassification where no «natural» developments have taken place, does not require irreversible degradation, and does not provide for participation by parties affected by the review procedure.
