Abstract

This paper aims to analyse the Trianel (C-115/09) and Brown bear (C-240/09) judgments of the European Court of Justice (ECJ) concerning the access to justice of environmental NGOs. In these judgments the Court interprets the Aarhus Convention and the European Directive 2003/35/EC in order to determine the obligations which these regulations impose on the Member States. Their impact on German law is especially significant because access to justice of environmental NGOs has always been a highly controversial issue and has therefore been subject to restrictive regulation. The German legislator faces now the challenge of introducing the changes imposed by European law and maintaining at the same time the coherence of Administrative Procedure Law.
