Abstract

This article provides an overview of the remedies system available in England’s procurement landscape. The article starts doing a description on the traditional features of public contracting and their evolution —e.g. discretion framed and an increase in litigation. The article refers largely to the different regimes on remedies i.e the remedies in case of contracts under European regulation, the remedies of the so-called judicial review and the ordinary remedies. After dealing with those elements which are common to these regimes, a particularized analysis on remedies is carried out. The article ends by giving an example on how the procurement system heads towards it administrativization – Monitor review body.
