Abstract

STC 136/2024 has reinterpreted the Law of exception in our legal system, giving
the state of alarm a new constitutional status. This third reconfiguration allows
it to establish limitations materially equivalent to the suspension of fundamental
rights, measures not foreseen in its regulatory Organic Law, as well as to obviate the
constitutional distribution of competences. This new position, together with its legal
rank and the absence of parliamentary control during the first fifteen days, makes it
a dangerous instrument for the Rule of Law.
