Abstract

This article focuses on means of alternative dispute resolution. It studies its ever more common implementation under Administrative Law, with special reference to mediation, examining the French, German and English regulations. These distinguish between different types of mediation procedures, depending on whether they are carried out before or during the jurisdictional process, examining and evaluating their particular configuration in each national set of regulations. Finally, on the basis of this study, it provides a summary of the common elements and argues that alternative dispute resolution provides better ways to achieve the goals of resolving disputes than transaction or arbitration.
