Abstract

The process of economic liberalization, such as energy, telecommunications fields, brought a period of transition from monopoly to free market. This transition has been directed by the states using a profuse regulation aimed at promoting competition and protection of the users. The concept of regulatory risk is born the hand of the Supreme Court when firms (in the energy sector) affected by continuous regulatory adjustments, claiming for the responsibility.
