Abstract

The Internet has become an omnipresent reality, both in our personal and collective lives. However, the risks it offers to citizens are obvious. One of them is what happens to heritage after death, in relation to activity carried out on the Internet, through the fingerprint and digital assets, which are stored on different servers in the cloud that, generally, are managed through password protected accounts. In this sense, we intend to reflect on the essential questions that will arise in a possible digital and international succession mortis causa, to later analyze the application of the Regulation of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and on the creation of a European Certificate of Succession.
