La evaluación de la actividad administrativa desde la revisión judicial: Una comparación entre los niveles territoriales de la Administración

Resumen

El presente estudio compara el funcionamiento de los distintos niveles territoriales de la Administración pública española a partir de la revisión de su actividad por los tribunales de la jurisdicción contencioso-administrativa. La aplicación de un modelo de regresión logística sobre 2.363 sentencias de los tribunales de la jurisdicción contencioso-administrativa durante el período febrero 2019-febrero 2020 permite analizar la influencia de factores relacionados tanto con la organización administrativa y la gestión pública (nivel territorial de la Administración, ámbito material de actuación o el carácter expreso o presunto del acto impugnado) como con las características del proceso mismo de revisión judicial (tipo de recurrente, órgano jurisdiccional sentenciador). Los resultados apuntan a una mayor impugnación de la actividad administrativa en el caso de la Administración General del Estado, si bien la revisión judicial de la actuación administrativa se produce más frecuentemente en actos adoptados por órganos de los niveles local y autonómico. Detrás de estas diferencias está la mayor frecuencia de los actos presuntos (silencio administrativo) en esos niveles y la complejidad del marco normativo en asuntos relativos a tributación, contratación pública y de personal al servicio de la Administración. Estos resultados justifican la utilidad del análisis empírico de los procesos de revisión judicial para completar los estudios sobre la evaluación del desempeño de las administraciones públicas y localizar aquellos sectores donde se puede mejorar la eficacia de la Administración Pública.
