Valor jurídico administrativo de las actuaciones presidenciales en Twitter: actos de gobierno 2.0. en la República del Ecuador

Resumen

Este artículo analiza los alcances legales y administrativos del uso de Twitter como medio de comunicación y gestión institucional, y su relación con los mecanismos legales o institucionales en el caso de la República del Ecuador. Se propone que la actuación presidencial en la red social tiene consecuencias en la Administración Pública en forma de centralización de la toma de decisiones y el mandato político. Para indagar sobre esta cuestión, se realiza un análisis cuantitativo y cualitativo de la cuenta del presidente de la República (utilizada como herramienta directa de gestión entre ciudadanos y Gobierno), a través de la metodología de análisis de redes sociales, relacionada con el sistema legal ecuatoriano. Los datos demuestran la existencia de un mecanismo legal que otorga cierta legitimidad a las actuaciones presidenciales dentro de la red social, y que las pautas de comportamiento de la primera autoridad del Ejecutivo dentro de la web 2.0 son una fuente de derecho que aumenta la percepción de eficiencia de la acción del jefe del Estado.

Doctor en Gobierno y Administración Pública por la Universidad Complutense de Madrid, licenciado en Ciencias Jurídicas y abogado por la Pontificia Universidad Católica
del Ecuador (PUCE), máster en Protección de Derechos Humanos por la Universidad de Alcalá y máster en Gobierno y Administración Pública por la Universidad Internacional Menéndez Pelayo, Instituto Ortega y Gasset. Subdecano de la Facultad de Jurisprudencia de la PUCE. Sus líneas principales de investigación son la calidad de la democracia, la conflictividad social y las interacciones entra la política pública y los derechos humanos.
