Abstract

Political parties are of key importance to modern democracies. Nowadays, parties (referred to as «constitutionally relevant associations» by the Constitutional Court) almost completely monopolize the political arena. Given this position in the constitutional system, their rules merit special attention. The law (sometimes expressly, sometimes implicitly) sets out specific imperatives for those rules, and that gives them undeniable juridical singularity. There are three concrete points which underline the rules of political parties’ peculiar nature: their content, their administrative control and their publicity. This work provides a juridical and constitutional reflection on such aspects.
