Abstract

The purpose of this paper is to reconstruct Böckenförde’s conception of the distinction between state and society in light of his broader understanding of
the State. To that end, the work is structured in three parts. First, it examines how Böckenförde conceives the ethical justification of the state through an analysis of its emergence as a product of the secularization process. Second, it reconstructs the meaning that the distinction between state and society acquires within that framework. Third, it introduces the author’s reflections on the current possibilities of preserving that distinction. Finally, the paper summarizes the key points and outlines some concluding remarks.
