Abstract

The legal norms integrated in the new Pact on Migration and Asylum do not resolve the main challenges faced by the European Union in this area, as they prevent the creation of a true common European asylum system that is efficient, supportive and guaranteeing. Thus, although they discourage unilateral actions, preserving the capacity for joint action in order to deal with the management of future migratory crises, they avoid resolving issues that are in demand, such as the excessive responsibility that falls on the countries that are the external border of the EU. Rather, it increases their obligations, betting on making it more difficult for migrants to enter the territory of the Union. Moreover, the proposed solidarity system establishes an «à la carte menu» for Member States, which pushes the protection of people arriving in Europe into the background. Hence, the reluctance of such laws to create a mandatory relocation mechanism. As a result, the system has become more complex, leading to a decrease in safeguards, as seen in the provisions on procedures and crisis management, which main emphasis is placed on increasing returns. Thus, in its obsession with reinforcing security and safeguarding European public order, it fails to create a common migration policy, worthy of the name, that responds to the values and principles set out in the Treaties.
