Abstract

This study delves into the adaptation of strategic litigation as a legal tool aimed at safeguarding the rights of women and girls migrating due to climate-related reasons. To scrutinize this adaptation, the article explores the concept of climate litigation as a specific form of strategic litigation, adopting a rights-focused perspective. It investigates the application of climate litigation in instances of forced human mobility resulting from adverse climate events, and in cases initiated by women who are recognized as particularly vulnerable to the detrimental impacts of climate change. Acknowledging the considerable challenges in establishing a specific causal link between gender-migration and climate change, the article evaluates the significance of climate
litigation initiated by migrant women. This is viewed as a means of agency for these women in contributing to the establishment of an equitable climate transition.
