Abstract

This paper examines the constitutional suitability of the intergovernmental collaborative relations between the central State and the Autonomous Communities developed in the context of the deployment of the Next Generation EU Instrument, exploring both the potential and the limitations of collaborative techniques. Methodologically, the analysis builds on constitutional doctrine regarding the principle of collaboration, enriched on the one hand by developments in fiscal federalism —particularly with regard to empirical evidence associated with the design of intergovernmental transfers, such as non-repayable funds— and on the other by the socio-economic context and objectives inherent to the Instrument itself. Based on the outlined foundations, no general or prevailing collaborative technique can be inferred; however, a proportionately significant coordinating role for the central State, along with informal cooperation in the implementation of the funds, can clearly be identified. In any case, as a corollary to the State’s discretion over the Recovery and Resilience Facility (RRF), regional criticisms regarding their individual financial participation must be acknowledged —though not in relation to their autonomy to select projects financed with territorially allocated funds.
