Functional problems of relations of collaboration in Spain

Abstract

This paper explains the functional problems of relations of collaboration in Spain. We are faced with a State with a federal structure in which it is necessary for the relations of collaboration between the State and the Autonomous Communities, and between the Autonomous Communities themselves, in the exercise of their respective competences, to function properly. However, the Constitution has not provided for them, and the legislator has been configuring a regulatory framework that is still insufficient. The different forms of collaboration (aid, voluntary cooperation and coordination) and the cooperation and coordination bodies (sectoral conferences, Conference of Presidents) are explained. Within this framework, the most significant problems of the system of collaborative relations are described and specific proposals are put forward to improve the way it works and to establish a culture of collaboration that does not exist at present.
