The theoretical construction of the relations of ordination and its refinement by Manuel García-Pelayo

Abstract

The notion of relations of ordination represents a Constitutional Law construct, particularly within the context of federal theory, which seeks to elucidate the relationship between central power and subnational entities. The relations between the two levels can be classified into three categories: coordination, supra and subordination, and inordination (or participation). Each category is composed of a set of elements, the precise specification of which depends on the constitutional framework of the respective state. The application of this category has gained considerable traction, particularly in Spain and Latin America, following the publication of Manuel García-Pelayo’s seminal work, Derecho constitucional comparado. This article aims to analyse the creation and evolution of the category, which was formulated at the beginning of the 19th century and gradually developed and enhanced over more than a century. It subsequently examines the scope of García-Pelayo’s contributions to its refinement and culmination.
