Sexual binarism as modern-colonial technology. Notes towards a legal articulation of diversity

Abstract

The article explores what has come to be known as the unity trap by means of several examples of positions that oppose the recognition of rights for transgender people. This unity trap aims to preserve sexual binarism. This objective is outlined in the text as part of a modern/colonial technology. Finally, through various categories constructed from the feminisms of the global south, several legal examples (especially jurisprudential ones) are highlighted, which allow us to think of possibilities to break the unity trap and to legally construct diversity.
