Abstract

Carl Schmitt's influence on many Spanish professors is well known. In particular, the Schmittian influence on the generation that suffered the Spanish Civil War and continued their academic careers in post-war is enormous. In this paper, we trace Schmitt's influence on Manuel García-Pelayo's thinking. The topic is very wide. For this reason, we can’t exhaust the subject. Therefore, we restrict our analysis to some of Schmitt's important ideas and concepts which the first president of the Spanish Constitutional Court has integrated into his thinking. In addition to theoretical coincidences, García-Pelayo shared a long friendship with Carl Schmitt from 1936 to 1985. Examples of this friendship are some of the unpublished letters reproduced in this text.
