A constitutionally relevant hitch: Collaboration Pacts versus Cooperation Agreements between Autonomous Regions in Spain

Abstract

This paper proposes a new doctrinal criterion in order to distinguish between the two types of inter-regional agreements found in the article 145.2 of the Spanish Constitution, which Spanish law treats very differently. The first type is dealt with through Collaboration Agreements to provide and manage their own services; and the second with Co-operation Agreements. We give the grounds of our defending a criterion that helps to define both kinds of agreement to ensure a better fit with recent practice and the will expressed in the Constitution.
