Abstract

The privatization of the religious phenomenon in the Modernity has implied the recognition of the religious freedom and the separation between the State and the religious organizations. These two legal tools have been used, respectively, by the European Court of Human Rights and the United States Supreme Court to judge State sponsored religious symbols. The article analyses the case-law of both courts, and suggests that the differences between them are not only due to the legal tools used, but also to their different institutional position and to the interpretive criteria used by the judges.
