Constitutional challenges for municipalities in Mexico

Abstract

The local government constitutional rules determine the possibility to develop different kind of municipalities. In Mexico the similar institutional rules oppose to the municipal diverse social and economic conditions. The national constitutions establish different ways to regulate local governments. From those that overlook this topic (United States), leaving to the states their entire regulation; going through the establishment of general principles (Germany); until those frames that excessively regulate these governments (Brazil). In Mexico, the elimination or reduction of the national article 115 would permit the states to develop different types of local governments and administrations to confront their particular issues.
