Abstract

On the basis that there is a close link between the responsibility of judges and judicial independence, the author analyzes in this paper to what extent the current disciplinary liability regime commits the independent exercise of the judicial function.
The lack of a detailed regulation of the matter (given the absence of a development regulation), as well as the succession of partial reforms in it, contributes to a weak situation that would affect the judicial independence itself.
