Abstract

The 2007 education act brought in «citizenship education» as part of the Spanish curriculum. It was to be taught at primary, secondary and high school levels. This subject is mentioned in recommendations from the Council of Europe and the European Union, but it has triggered a broad-ranging debate regarding its political and its legal and constitutional aspects. The article defends the constitutionality of bringing this subject on to the curriculum. It provides jurisprudence from the German federal constitucional court and the European Court of Human Rights.
