Abstract

This paper considers that the European integration reshape the classical topic of the legitimacy of the constitutional jurisdiction. To understand this problem, the essay analyzes the case of the German Constitutional Court. Therefore, its theoretical foundations are underlined, as well as the criticizes reconstruction of its jurisdiction. Finally, the paper the jurisprudence of the German Constitutional Court and propose another solution based on the clarity of the canon of control.
