Abstract

This paper deals with two judgments of the Court of Justice of the European Communities held in the case A. Brünster GMBH, Autohaus Hilgert GMBH y Bayerische Motorenwerke AG (C-376/05 and C-377/05) and in the case City Motors Groep NV y Citroën Belux NV (C-421/05). Our purpose is to define the scope of the both Community law and national laws in relation to the motor vehicle distribution contracts. Particularly, it is worth highlighting the relevance of the lex contractus in the field of Community competion law in order to establish the efects of the invadility of some contractual provisions.
