Abstract

This article analyses the concept and operation of good administration in both European Union law and Spanish law. Specifically, it identifies the various expressions encompassed by the requirement of good administration; the divergences observed between Spanish law and European Union law regarding citizens’ safeguards; as well as the unexpected contribution that this requirement
of good administration may offer to the Spanish legal system, due to its guiding value for administrative actions carried out without a formal procedure and for the legal position of citizens in relation to such actions.
