Abstract

According to the so-called doctrine of the margin of tolerance, public administrations
are not liable for damages caused by their unlawful decisions when these are
the result of a reasonable and reasoned application of the law, i.e., when the relevant
public administration acted with due care when issuing them. This paper analyzes
why and to what extent this doctrine is justified, especially in view of the severe criticism
it has received in recent years.
