Abstract

The morality of Administrative Law is a proposal aimed to enable a rational

administrative action towards the common good, as a reply to the recent critics about

the expansion of the administrative state in the United States. Rather than dismantle

the modern administrative state, Sunstein and Vermeule propose to use Fuller´s ideas

about the “inner morality of the Law”, to build a system of general principles. This

proposal connects with the general principles of Administrative Law, deeply recognized

in the administrative procedure laws in America Latina, as well as in the good

administration standards. Therefore, the morality of administrative law facilitates the

comparative study between the modern Administrative Law in the United States and

Latin America.
