Abstract

This paper examines a recent Supreme Court judgment that decides an appeal

about sanctions for infringement in the field of audiovisual commercial communication,

specifically for undue prominence in the product placement. The commentary

highlights the case background and its legal context. The analysis is carried out in

order to illustrate various underlying problems that give rise to some critical considerations.

These considerations refer to the following topics: the consequences of the

sanctioning nature of the decision; the assessment of the facts and the application

of indeterminate concepts by the regulatory body, the legal value of soft law and the

scope of judicial control.
