Abstract

The Constitutional Court’s judgment no. 191/2020, of 17 December 2020, addresses a claim for the protection of fundamental rights filed by a private university. The claim challenged an administrative regulation preventing students enrolled in private universities from obtaining any public grants and scholarships. These were limited to students enrolled in public universities that were part of the regional higher education system. The Constitutional Court holds the limitation contrary to the right to equality of the private university taken together with the freedom to establish schools, and consequently grants the plaintiff protection.
