Abstract

The abusive use of interim civil servants by the succession or excessive duration of their appointments has been considered contrary to European law (Directive 1999/70). However, Spanish law lacks adequate measures to punish these abuses, since the Court of Justice has negatively assessed on both the processes of consolidation or stabilization and the conversion into indefinite —but not permanent— the interim officials’ appointments. Therefore, although it has been considered that European law would require either converting interim officials into permanent (career officials) or recognizing a right to a compensation, the truth is that neither this conversion nor the aforementioned right derives from the Directive 1999/70.
