Abstract

This study examines the distribution of competencies between the state and the autonomous communities with respect to national parks, in the light of recent constitutional jurisprudence, based on Ruling 194/2004, of 10th November, the doctrine of which was completed by other subsequent Rulings. In particular, it analyses the competencies of the state and the autonomous communities on such issues as the creation, management, organization, planning, funding and system of sanctions established for national parks. The analysis shows the progressive decrease in state competencies and the progressive increase in the competencies of the autonomous communities.
