Abstract

The concurrence of authorities entrusted with the enforcement of Spanish Competition Law (competition authorities and regulatory authorities) has provoked, in the past years, important coordination issues that have even questioned the unity of the Spanish competition system. Indeed, it has not been infrequent that regulatory and competition authorities have adopted contradictory decisions when assessing, in parallel, conducts of uncertain compatibility with the principles of open competition. The recently adopted Spanish Competition Act has introduced coordination mechanisms between the newlycreated Spanish Competition Authority (Comisión Nacional de la Competencia) and regulatory authorities aimed at preventing such ambiguous situations. The aim of this paper is to analyse these coordination mechanisms.
