Abstract

The new «Ley 8/2007, de 28 de mayo, de Suelo» includes two big blocks of rules: the first one is dedicated to define in other terms the right of property, and the second one organizes a new system to fix the price of the land. The main change introduced in the traditional regulation of the property is the elimination of the faculty to develop the own land. This faculty is «nationalised» and can be retained by the public authority or conceded to a private agent. The new system established to appraise the land takes account only of the real situation, urban or rural, of the land. In rural situation, the appraisal depends only of the income produced (really or potentially) by the land, without including the urban expectation.
