Abstract

This article deals with the dilemmas as to what information government administrations should make public and what information they should limit access to. Information is a key issue in public law and its legal dogma is currently being laid down. The question is analysed with reference to European law, comparative law and Spanish law. The study is not limited to normative regulations, jurisprudence, the positions of the data protection agencies and doctrine. It also looks into the guidelines that should govern access. It provides raw material for a legal debate that could establish an integrated standard to regulate access to information held by the public sector, how it may be re-used, how administrative archives should be run and privacy and data protected.
