Abstract

Here we discuss the institution of the transnational unilateral and binding decision, understood as any unilateral and binding decision that has full effect in countries different from that in which it is issued. The existence and extension of the figure, which is completely new in spanish doctrine, creates important problems, among which is that of judicial control, which demonstrates (and is the consecuence of) the need for a reasonable harmonization of the the procedures and material requirements of the decisions in the different countries. Similar problems arise also in complex countries, although the existence of shared systems of judicial control renders this figure less problematic.
