Abstract

The new Costa Rican Code of Contentious Administrative Procedure (Law 8508 of April 24, 2006 which came into force on January 1, 2008) is a legal instrument, which introduces a number of innovations in the administrative justice of the country to achieve a whole and universal control of the legality of the administrative function. It also incorporates tools that seek to humanize, ease, speed up, and enforce the administrative judiciary in the protection of substantive legal situations of citizens against public authorities. The fundamental objective of this legislation has been its alignment with the constitutional paradigm, removing procedural privileges of the government and seeking to establish a symmetrical process.
