Abstract

The European Convention on Human Rights contains no reference to cultural heritage, but the European Court of Human Rights repeatedly stated that their protection is a legitimate aim justifying interference with property rights. However, the case law states that the legitimacy of the aim —the protection of the country’s cultural heritage— does not allow public authorities acting outside the requirements of the European Convention, basically the principle of fair balance between the demands of the general interest of the comunity and the individual’s fundamental rights.
