Abstract

Some contents of the regulation about Administrative Litigation Jurisdictional Bodies and some judicial practice can create difficulties to the satisfaction of the right to effective protection from the judges and the courts, and to the social perception of such a right. In all cases studied, the imbalances advantage the public Administration, which, thus, adds procedural advantages, in my opinion, not always justified. Time to take legal action, territorial jurisdiction, proof, enforcement of court judgments and legal costs, are the areas in which this study identifies legal or jurisprudential difficulties and suggests possible solutions.
